Welcome to Volée Haus. These Terms of Service ("Terms") are a contract between you and Volée Haus LLC, a California limited liability company ("Volée," "we," "us," or "our"). They govern your use of voleehaus.com (the "Site") and our community features (collectively, the "Service").
Important: These Terms cover use of the Site and your account. Participation in any in-person event (tournaments, social play, clinics) is governed separately by our Master Participant Agreement, which you accept at signup. That Agreement contains your release of liability, assumption of risk, media consent, indemnification, and other event-specific protections. Both documents apply when you participate in events.
By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Code of Conduct. If you do not agree, do not use the Service.
1. Who can use the Service
1.1 Age requirements
- You must be at least 13 years old to create an account.
- You must be at least 18 years old to register for any tournament, paid event, or prize-eligible event.
- If you are between 13 and 18, your parent or legal guardian must consent to your account and assume responsibility for your activity.
1.2 Eligibility
You may use the Service only if you can form a binding contract with Volée, are not barred from using the Service under U.S. law, are not located in a country subject to U.S. embargo (including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea region of Ukraine), are not on any U.S. government list of prohibited or restricted parties (including the OFAC Specially Designated Nationals list), and agree to comply with these Terms. We may refuse service to anyone at our discretion.
2. Your account
2.1 Creating an account
You agree to provide accurate information when you sign up and to keep it current. You are responsible for keeping your password confidential and for all activity that happens under your account. Notify us at admin@voleehaus.com immediately if you suspect unauthorized access.
2.2 One person, one account
Each account belongs to one human being. You may not share, sell, transfer, or co-register an account. Creating multiple accounts to manipulate rankings, evade bans, or claim duplicate event spots is grounds for suspension.
2.3 DUPR ratings
If you connect a DUPR (Dynamic Universal Pickleball Rating) ID to your account, you authorize us to retrieve your current rating and to submit match results to DUPR on your behalf for events you participate in. You are responsible for ensuring the DUPR ID you provide belongs to you.
2.4 Account deletion
You may request deletion of your account at any time through your account settings. Deletion begins a 30-day grace period during which you can reactivate by logging in. After 30 days, your profile data is permanently de-identified per our Privacy Policy.
3. Events and registration
3.1 Registering for events
When you register for an event, you agree to: (a) the event-specific rules listed on the event page, (b) our Code of Conduct, and (c) the reaffirmation of your Master Participant Agreement presented at registration, which includes the event's media-consent requirements.
Doubles events require a partner. You may register with a confirmed partner, register as needing a partner (subject to availability), or use the "swap-my-spot" feature to transfer your spot to another player before the event starts, subject to the rules in the event listing.
3.2 Payment and entry fees
Entry fees are processed by Stripe. Volée does not store credit card information. By submitting payment, you agree to Stripe's terms and authorize us to charge the listed entry fee plus any disclosed processing fees.
3.3 Refunds and cancellations
Entry fees include Stripe processing fees (currently 2.9% + $0.30 per transaction), which Stripe does not return to us on refunds and are therefore non-refundable to you.
If you cancel your registration:
- Cancellation more than 7 days before the event: full refund minus Stripe processing fees
- Cancellation 3–7 days before the event: 50% refund minus Stripe processing fees
- Cancellation less than 3 days before the event: no refund
If Volée cancels the event:
- Full refund to all registered participants, including Stripe processing fees (we absorb them), regardless of timing
- We will notify you by email and on the event page; refunds are issued to the original payment method within 7–10 business days
If your partner withdraws and we cannot find a replacement:
- Same partial-refund schedule as your own cancellation, applied to the date the partner withdraws
We may offer credit toward a future event in lieu of a refund at your option. Refund decisions outside of these rules are at our discretion.
3.4 Prize money
Some events offer cash or non-cash prizes. You are responsible for any tax owed on prizes you receive.
If you receive $600 or more in cumulative prize value from Volée in a single calendar year, you must complete a Form W-9 before we can disburse your prize. This is required by IRS reporting rules.
If you decline to provide a W-9, we are required by the IRS to withhold 24% backup withholding from your prize payment and remit it to the IRS on your behalf. You will still receive a Form 1099-MISC reporting the full payment, and the backup withholding will be credited toward your annual tax liability when you file.
Prize money is paid by check, ACH, or Stripe payout at our discretion, typically within 14 days of the event's conclusion (or 14 days after we receive a completed W-9, whichever is later).
4. Your conduct
4.1 Code of Conduct
You agree to follow our Code of Conduct at every event and on the Service. Violations may result in warnings, suspension, or permanent ban from the Service, at our discretion.
4.2 Prohibited activities
You may not:
- Cheat, sandbag (intentionally misrepresent your skill level), or manipulate match scores
- Harass, threaten, discriminate against, or harm other users, staff, or volunteers
- Use the Service to send spam, malware, or unsolicited commercial messages
- Scrape, copy, or harvest user data without permission
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Use the Service for any unlawful purpose
- Impersonate any person or misrepresent your affiliation with any organization
- Interfere with or disrupt the Service, including by overloading our servers
Tournament-day authority of the tournament director and the procedure for on-court disputes are governed by the Master Participant Agreement and the event rules.
5. Content
5.1 Photos, video, and likeness at events
Photo, video, and media consent for in-person events is governed by Section 9 of the Master Participant Agreement ("Photo, Video, and Media Consent"), which you accept at signup and reaffirm at each event registration. That consent is perpetual, royalty-free, and worldwide and covers all media now known or hereafter developed — including AI/video gameplay analytics (e.g., PB Vision).
You may request that we discontinue using your image in future marketing materials by emailing admin@voleehaus.com. We will honor reasonable requests in good faith. We cannot retract materials already distributed (social media posts, sponsor decks, press materials, etc.) — once published, they may be cached, indexed, or redistributed by third parties beyond our control.
5.2 User-submitted content
When you post content to the Service (profile photo, team name, bio, comments), you grant Volée a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute that content as needed to operate the Service. You represent that your content does not infringe any third party's intellectual property, privacy, or publicity rights. You may remove content from your profile at any time.
6. Our content
The Service, including the Volée Haus brand, logos, software, designs, text, images, and other materials we create, is owned by Volée and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of our content without our written permission, except as permitted by these Terms.
7. Third-party services
The Service integrates with third-party services including Stripe (payments), Supabase (data hosting), Resend (email), DUPR (rating data), PB Vision (video analytics), and Sentry (error monitoring). Your use of those services is governed by their own terms and privacy policies. Volée is not responsible for third-party services beyond our reasonable choice of vendor.
8. Termination
8.1 By you
You may stop using the Service at any time. You may delete your account through your account settings — see Section 2.4 and our Privacy Policy for what happens to your data.
8.2 By us
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or our Code of Conduct, if continued service poses legal risk to us, or if you have not used the Service in 60+ months. We will refund any pre-paid future event fees unless your termination is for cause.
8.3 Survival
The following sections survive termination: 5 (Content licenses), 9 (Disclaimers), 10 (Limitation of liability), 11 (Indemnification), 12 (Dispute resolution), and any other provisions that by their nature should survive.
9. Disclaimers
9.1 The Service is provided "as is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VOLÉE DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or secure, that any information will be accurate or reliable, or that defects will be corrected.
9.2 Assumption of risk for in-person events
Physical injury and other risks at in-person events are addressed by the Master Participant Agreement, which contains your assumption of risk, release of liability, and waiver of California Civil Code §1542. Nothing in these Terms limits or replaces those event-specific protections.
9.3 Third-party content
We are not responsible for content posted by other users, for DUPR ratings, for PB Vision analytics output, or for the accuracy of any third-party information displayed on the Service.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VOLÉE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VOLÉE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
This cap applies to claims arising from your use of the Site and Service. Claims arising from in-person event participation are governed by the separate liability provisions of the Master Participant Agreement.
11. Indemnification
You agree to indemnify, defend, and hold harmless Volée and its officers, members, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third party's rights, or (d) any content you post. Event-specific indemnification (for in-person event participation) is governed by the Master Participant Agreement.
12. Dispute resolution
12.1 Informal resolution first
Before filing a formal claim, you agree to contact us at admin@voleehaus.com and attempt to resolve the dispute informally. We will respond within 30 days. Most disputes can be resolved this way.
12.2 Court venue and jury waiver
Any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND VOLÉE EACH WAIVE ANY RIGHT TO A JURY TRIAL in connection with any claim arising under these Terms.
This venue clause is consistent with the Master Participant Agreement; both documents direct disputes to the same court system.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and post the updated Terms on the Site at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Notice of material changes is sent as transactional email and cannot be opted out of while you maintain an account. (This is separate from marketing email, which you control via your account settings.)
If you do not agree to the changes, you must stop using the Service and delete your account before the effective date.
15. Miscellaneous
- Entire agreement. These Terms, together with the Master Participant Agreement, the Privacy Policy, and the Code of Conduct, constitute the entire agreement between you and Volée regarding the Service and your participation in events.
- Severability. If any provision of these Terms is held invalid, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
- Assignment. You may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, pandemics, court closures, internet outages, etc.).
